Gonzaga keeps Bennett eligible as Ohio order stands

The Supreme Court of Ohio kept a lower-court order in effect on October 29 while it considers whether to take an eligibility case. That keeps a path open for named basketball players, including Gonzaga guard Javon Bennett, as the season begins. For the No. 15 Bulldogs, the practical question is whether they can plan on Bennett in their guard group for Monday's opener against Purdue. The order provides a current answer. It does not settle the case for the season.

The court's wording matters. It says an October 2 appeals-court judgment and mandate "remains stayed" and that the Hamilton County Common Pleas Court's order "remains in effect" pending consideration of jurisdiction. The court did not issue a final decision on the NCAA's age-based eligibility model. Its order concerns the parties in this case.

Gonzaga's immediate guard picture

Gonzaga lists Bennett as a guard on its 2026-27 roster. Its October 30 opener preview says he scored 11 points in the exhibition against Lewis-Clark State. That is evidence he has already played with this group in an exhibition. Monday against Purdue would be his first regular-season game for Gonzaga if his status continues to hold.

The value of the order to Gonzaga is straightforward. Bennett can remain in the available guard pool while the court reviews the case. Coaches can plan a rotation around players who are currently eligible, but a pending court case leaves a different level of certainty from a completed eligibility ruling. His possible minutes against Purdue are a basketball decision, not something the court's order determines.

What could change

The next legal trigger is the Ohio court's jurisdiction decision or a later order changing the stay. Until then, the lower-court order remains operative for these plaintiffs. CBR's August overview of the fifth-year disputes described a different court map at that time. Thursday's document is a fresh step in the Ohio case, and its narrow wording is the reason Bennett's present status should be reported with a date.

For recruits watching college rosters, the lesson is concrete: a named veteran can be available to a ranked team while an eligibility case is still open. That affects the minutes a staff might have to distribute now. It does not create a fifth season for every player who entered college in 2022.
